Nomad respects your privacy and is committed to protecting your Personal Data. This Privacy Policy will inform you as to how we look after your Personal Data when you visit our Platform (regardless of where you visit it from) and/or use our Services.

Please use the Definitions below to understand the meaning of some of the terms used in this Privacy Policy. Unless specifically defined, any capitalized terms used throughout this Privacy Policy (but not defined herein) shall have the same meaning attributed to it in Nomad’s General Terms and Conditions. Please read this Privacy Policy carefully before using the Platform or submitting any information to us. If you do not agree to any part of this Privacy Policy, you shall immediately cease from accessing our Platform or using any of our Services.

Definitions:
a. "Comply with a legal or regulatory obligation" means processing your Personal Data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.
b. "Data" means personal and non-personal User’s data that is submitted, generated, featured, and displayed through the Platform, collected from the use of the Service, and stored on Nomad’s servers.
c. "Legitimate Interest" means the interest of our business in conducting and managing our Services to enable us to give you the best Service and the best and most secure experience. We consider and balance any potential impact on you and your rights before we process your Personal Data for our legitimate interests.
d. "Nomad’s General Terms and Conditions" means all of the terms, conditions, and notices contained or referenced in Nomad’s General Terms and Conditions and all other Nomad rules, policies available at https://public.nomadhomes.co/nomad-terms-and-conditions, as amended from time to time.
e. "Performance of our Services" means processing your Data where it is necessary for the performance of our Services.
f. "Personal Data" means information that specifically identifies an individual (such as a name, address, photo, telephone number, mobile number, e-mail address, birthday, office location, professional and personal interests, company name, title department, spoken languages) or information about that individual that is directly linked to personally identifiable information.
g. "Platform" means any online tool provided, processed, and/or maintained by Nomad (including, but not limited to, through the Nomad Agent mobile application, Nomad’s website, all subpages and subdomains, all Content, Services, and products available at or through the Platform located at http://nomadhomes.co/ and http://nomadhomes.fr/ or any related domain or any mobile application offering access to, or facilitating the provision of, the Services);
h. "Property" means any real estate property that is listed on the Platform for sale and/or rent through the Platform;
i. "Privacy Policy" means all of the privacy policies, practices, and notices contained or referenced in this document (as amended from time to time) and all other Nomad rules, policies available on the Platform that may be published from time to time on the Platform.
j. "Service" means the online and/or offline services provided by Nomad for the provision and use of the technology that Nomad has developed to facilitate the access of Buyers and Tenants and to Agents and Agent Services, including, without limitation, providing access to Nomad’s online community and communication tools.
k. "User," "you," and "your" collectively mean the person, company, or organization that has visited or is using the Platform and/or the Service. A User may be, without limitation, an Agent, a Buyer, a Tenant, both, or neither.
Data Processing Agreement (DPA)

1. Data Processing Responsibilities
1.1 Data Controller: Real estate agents ("Agents") using the Nomad platform are considered data controllers for Personal Data they capture, or obtain consent for from buyers or tenants.
1.2 Data Processor: Nomad acts as the data processor, processing Personal Data on behalf of the Agents to facilitate targeted email communication and property transactions.

2. Purpose of Data Processing
2.1 Data Controller Purpose: Agents capture Personal Data and gain consent from individuals to connect with potential buyers or tenants on the Nomad platform for property-related communication and transactions.
2.2 Data Processor Purpose: Nomad processes Personal Data on behalf of Agents to facilitate communication and transactions as per the Agents' instructions.

3. Data Processing Compliance
3.1 Compliance with Applicable Laws: Both Agents and Nomad shall comply with all applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR).
3.2 Data Security: Nomad shall implement appropriate technical and organizational measures to protect Personal Data, and Agents shall take reasonable steps to ensure the security of Personal Data they capture on the platform.

4. Data Subject Rights
4.1 Access and Rectification: Agents shall respond to data subject requests for access, rectification, or erasure of Personal Data in accordance with applicable data protection laws. Nomad shall assist Agents in fulfilling their obligations.
4.2 Cooperation: Agents shall promptly inform Nomad of any data subject requests related to the Personal Data processed through the platform and cooperate in addressing such requests.

5. Data Breach Notification
5.1 Reporting: In the event of a data breach affecting Personal Data, Agents shall promptly notify Nomad, and Nomad shall assist Agents in their obligations to report such breaches to relevant data protection authorities and data subjects.

6. Data Retention
6.1 Data Controller Retention: Agents shall retain Personal Data captured or obtained through the platform for as long as necessary to fulfill the purposes outlined in their privacy policies and in compliance with applicable data protection laws.
6.2 Data Processor Retention: Nomad shall retain Personal Data as necessary to fulfill its obligations as a data processor and in accordance with the instructions of the Agents.

7. Termination of Services
7.1 Data Controller Termination: Agents may cease using Nomad's services at any time. Nomad will cease processing Personal Data upon termination and provide Agents with assistance as needed to facilitate data transfer or deletion.
7.2 Data Processor Termination: Nomad may terminate its services as a data processor for Agents if there are violations of data protection laws or non-compliance with this DPA or the Privacy Policy.

8. Governing Law and Dispute Resolution
This DPA is governed by and construed in accordance with the laws of France. Any disputes arising under or in connection with this DPA shall be subject to the exclusive jurisdiction of the courts of France.

9. Changes to DPA
This DPA may be amended by Nomad from time to time, and such changes will be reflected in the Nomad Privacy Policy. Agents are responsible for reviewing and accepting any updated terms.
By using the Nomad platform, Agents agree to comply with the terms and conditions outlined in this Data Processing Agreement.

1. Important information and who we are
1.1 Purpose of this Privacy Policy:
This Privacy Policy aims to give you information on how Nomad collects and processes your Personal Data through your use of the Platform, including any Data you may provide through the Platform when you register an Account, use any Service, and/or sign up for our newsletter, as well as installing and signing up for any Nomad mobile application.
Our Platform is not intended for children (persons under the age of 16) and we do not knowingly collect Data relating to children.

This Privacy Policy applies to the Platform and the website you are currently viewing. By clicking on the “Accept” button, you (i) agree irrevocably and without condition to this Privacy Policy, and (ii) consent to your Personal Data being collected, used, and disclosed as set out in this Privacy Policy.
You consent to us posting and using any photographs, content, and/or Personal Data you might upload on our Platform or have otherwise provided consent to publish on our Platform, blog, in our marketing material or social media channels, which we may use in order to provide information on our Services and/or products, the marketing of our Services and/or products or for the purpose of our functions and/or activities.

It is important that you read this Privacy Policy together with the Nomad’s General Terms and Conditions available at https://public.nomadhomes.co/nomad-terms-and-conditions, which may be amended from time to time, and any fair processing notice we may provide on specific occasions when we are collecting or processing Personal Data about you so that you are fully aware of how and why we are using your Data. This Privacy Policy supplements the other notices and is not intended to override them.
If you are a resident of the European Union, you may be protected by and enjoy additional rights under the European Union’s General Data Protection Regulation 2016/679, also known as GDPR.

1.2 Changes to the Privacy Policy and your duty to inform us of any changes in your Personal Data.
You agree that Nomad may amend this Privacy Policy from time to time, and in Nomad’s sole discretion. Although we will use our best endeavors to notify you of any amendment to this Privacy Policy, we will not be required to provide you with prior notification of such amendments or changes to this Privacy Policy.
Upon any amendment or change to this Privacy Policy, we will publish the amended Privacy Policy on the dedicated link available at our Platform. Your continued use of the Platform and/or the Service after the publication date of a revised version of this Privacy Policy constitutes your acceptance of its terms.

You agree and undertake to review our Privacy Policy each time you visit our Platform and/or prior to your use of any Services. If you do not agree to our Privacy Policy, as updated from time to time, you undertake to cease using our Platform and/or Services immediately.

Please note that it is crucial to the Performance of our Services and correct working of the Platform that the Personal Data we hold about you is accurate and current. Please keep us informed and updated if your Personal Data changes during your relationship with us.

1.3 Third-party links
Our Platform may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share Data about you. We do not control these third-party websites, plug-ins, and applications, whether or not they operate on top of the Platform or on an external website, and are not responsible for their privacy statements. When you engage such third-party website, plug-in or application, whether or not you have also left our Platform, we encourage you to read the privacy policy of each website, plug-in, or application you visit or engage.

2. The data we collect about you
2.1 What Is Personal Data?
2.1.1 Depending on which of our Services you use and how you interact with our Platform, we collect different kinds of information from or about you. We may collect, use, store and transfer different kinds of Personal Data about you which we have grouped together as follows:
a. Identity Data includes first name, last name, address, username or similar identifier, title, date of birth, and gender.
b. Contact Data includes billing address, delivery address, location, email address, and/or telephone numbers.
c. Payment Data includes bank account and payment card details, payment history.
d. Transaction Data includes details about payments to and from you.
e. Technical Data includes internet protocol (IP) address, your login data, browser type and version, make and model (mobile phones only), operating system, hardware version, platform, device settings and other technology identification on the devices used to access our Platform, file and software names and types, device identifiers, time zone setting and location, device locations such as through GPS, Bluetooth or WiFi signals, browser plug-in types and versions, operating system and platform, connection information such as the name of your mobile operator or ISP, browser type, language, and time zone, mobile phone number and IP address.
f. Profile Data includes any User profile information, any User’s username and password, any purchases or orders made by a Client, your interests, preferences, feedback, and survey responses.
g. Property Data includes any information about Properties that you may wish to buy, sell or lease, including Property photos, Property location (tower and unit number), Property price, Property features, and any other Property information that you may provide.
h. Marketing and Communications Data includes your preferences in receiving marketing from us, and your communication preferences.
i. Usage Data includes information about how you use our Platform, products and services and how you use your devices to access our Platform, including the screens you visit and searches you make.
j. Other Data includes:
i. photos or other data uploaded onto any part of our Platform by you or shared with other Users of our Platform by you via our Platform;
ii. communications with us via social media platforms, email, electronic messages and other electronic and non-electronic communications;
iii. third party partner information related to how you use our third-party partners, such as your reviews of our merchant partners or other service providers.
iv. your networks and connections made available to us, depending on the permissions you have granted, from your mobile and desktop devices' address book contacts, and other social media such as Facebook, Instagram and Twitter.

2.1.2 If you fail to provide Personal Data:
Where we need to collect Personal Data by law, or under the terms of a contract we have with you, or any other agreement between us (such as our General Terms and Conditions) and you fail to provide that Data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with the Service). In this case, we may have to cancel a Service you have with us but we will notify you if this is the case at the time.

2.2 How Is Your Personal Data Collected?
2.2.1 We use different methods to collect Data from and about you including through:
a. Direct interactions. You may give us your Identity, Contact, Property, and Financial Data by filling in forms or by corresponding with us by post, phone, email, or otherwise. This includes Personal Data you provide when you:
create an account on our Platform;
subscribe to our Service or publications;
request marketing to be sent to you;
enter a competition, promotion, or survey; or
give us feedback or contact us.

b. Automated technologies or interactions. As you interact with our Platform, we may automatically collect Technical Data about your equipment, browsing actions, and patterns. We collect this Data by using cookies, server logs, and other similar technologies. We may also receive Technical Data about you if you visit other websites employing our cookies. Identity and Contact Data from your social media profile when you interact with us through your social media accounts.

2.3 Special Categories of Personal Data
We may also collect, store and use the following "special categories" of more sensitive Personal Data:
a. Information about your race or ethnicity, religious beliefs, sexual orientation, and political opinions.
b. Genetic and biometric Data.
c. Information about your health, including any medical condition, health, and sickness records.
d. Information about criminal convictions and offenses.

3. How we use your Personal Data
3.1 We will only use your Personal Data when the law allows us to. Most commonly, we will use your Personal Data in the following circumstances:
a. Where we need to perform the contract we are about to enter into or have entered into with you.
b. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
c. Where we need to comply with a legal obligation.

3.2 Generally, we do not rely on consent as a legal basis for processing your Personal Data although we will get your consent before sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.

3.3 Purposes for Which We Will Use Your Personal Data
3.3.1 We have set out below, in a table format, a description of all the ways we plan to use your Personal Data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.
3.3.2 Note that we may process your Personal Data for more than one lawful ground depending on the specific purpose for which we are using your Data. Please contact us if you need details about the specific legal ground we are relying on to process your Personal Data where more than one ground has been set out in the table below.

3.4 Opting out
You can ask us to stop sending you marketing messages at any time by logging into the Platform and checking or unchecking relevant boxes to adjust your marketing preferences or by following the opt-out links on any marketing message sent to you or by contacting us at any time.

3.5 Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of a Product purchase or other transactions.

3.6 Cookies
You can set your browser to refuse all or some browser cookies or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. 4. Disclosures of your Personal Data
4.1 We may have to share your Personal Data with the parties set out below for the purposes set out in the table in paragraph 3.3 above.
a. External Third Parties.
Service providers acting as processors based inside or outside the EEA who provide IT and system administration services, such as Amazon Web Services. Please contact us if you would like to receive more information about our third-party data processors.
Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors, and insurers based inside or outside the EEA who provide consultancy, banking, legal, insurance, and accounting services.
Regulatory authorities based inside or outside the EEA who require reporting of processing activities in certain circumstances.
Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Policy.

4.2 We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third-party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.

5. International transfers
5.1 In this paragraph, "EEA" stands for the European Economic Area, which is all EU countries plus Norway, Iceland, and Liechtenstein.

5.2 Some of our external third parties are based outside the EEA, so their processing of your Personal Data will involve a transfer of Data outside the EEA.

5.3 Whenever we transfer your Personal Data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

6. Data security
6.1 We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your Personal Data to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your Personal Data on our instructions, and they are subject to a duty of confidentiality.
6.2 We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

7. Data retention
7.1 How long will you use my Personal Data for?

7.1.1 We will only retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

7.1.2 To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.

7.2 By law, we have to keep basic information about our clients (including Contact, Identity, Financial and Transaction Data) for six years after they cease being clients for tax purposes.

7.3 In some circumstances, you can ask us to delete your Data: see Request erasure below for further information.

7.4 In some circumstances, we may anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

8. Your legal rights
8.1 Under certain circumstances, you have rights under data protection laws in relation to your Personal Data. You have the right to:
a. Request access to your Personal Data (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.
b. Request correction of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate Data we hold about you corrected, though we may need to verify the accuracy of the new Data you provide to us.
c. Request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have successfully exercised your right to object to processing (see below), where we may have processed your Data unlawfully or where we are required to erase your Personal Data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
d. Object to processing of your Personal Data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your Personal Data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your Personal Data which override your rights and freedoms.
e. Request restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of your Personal Data in the following scenarios:
if you want us to establish the Data's accuracy;
where our use of the Data is unlawful but you do not want us to erase it;

However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

8.2 No fee usually required
You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to
comply with your request in these circumstances.
8.3 What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

8.4 Time limit to respond
We try to respond to all legitimate requests within one month. Occasionally, it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

9.1 Lawful Basis
Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Data for our legitimate interests. We do not use your Personal Data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). Performance of Contract means processing your Personal Data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
Comply with a legal obligation means processing your Personal Data where it is necessary for compliance with a legal obligation that we are subject to.

9.2 Third Parties
Internal Third Parties include other companies in our corporate group acting as joint controllers or processors, and who are based in Switzerland and provide IT and system administration services and undertake leadership reporting.
External Third Parties include:
Service providers acting as processors based in Switzerland and the United States, who provide IT and system administration services such as Amazon Web Services, Zendesk, and other third-party data processors. These providers assist in the provision of the Service.
Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors, and insurers based in Switzerland and other countries who provide consultancy, banking, legal, insurance, and accounting services.
Regulators and other authorities acting as processors or joint controllers based in Switzerland and other countries who require reporting of processing activities in certain circumstances.

9.3 Your Legal Rights

9.4 Data Retention Time
The length of time we retain Personal Data will depend on the purposes for which we collected it and for which we continue to process it, and on applicable legal requirements. We will securely delete Personal Data when it is no longer needed for these purposes, or where you withdraw your consent (where applicable) and there are no other legal grounds for the processing.
